Brian Henninger advises clients in the construction and management of capital projects. He specializes in project delivery strategies, construction and real estate disputes, and related insurance cost recovery counseling and litigation.
In his project delivery practice, Brian assists private and public owners in choosing delivery methods, allocating risk and negotiating contracts to maximize the owner’s chances of achieving operational, budgetary and schedule goals. He has assisted clients in delivering projects on time and on budget through design-bid-build, design-build, engineering, procurement and construction (“EPC”) and construction manager/ general contractor (“CM/GC”) delivery methods. Brian is also active in the emergence of Integrated Project Delivery (“IPD”) and “Lean Construction” as collaborative tools that can help add value to a project and reduce transactional costs associated with change orders, rework and defect disputes.

Brian’s construction and real estate disputes practice covers a broad spectrum of the industry, including major infrastructure projects, commercial facilities and private and public housing projects. He represents both owners and contractors in lawsuits and ADR proceedings, including the ICC, AAA and other arbitration programs. As an adjunct to his construction work, Brian counsels real estate developers and property managers on numerous disputes arising from use and/or ownership of commercial and residential property, such as personal injury claims, commercial lease disputes and property damage caused by design defects.
In his insurance cost recovery practice, Brian works with owners, property managers and contractors to make sure they receive the benefit of their bargain from insurance carriers when a claim or occurrence results in covered losses. He has mediated and litigated insurance disputes stemming from losses related to personal injuries at commercial and residential facilities, property damage related to construction defects, and long tail claims arising from asbestos exposure. Brian also consults with capital project teams to address project-specific risks through contractual risk-sharing mechanisms and insurance programs.
