Diana Tsutieva is an Associate in the firm's Washington office.  She is a dually qualified U.S.-French attorney, focusing her practice on international dispute resolution.  Prior to joining Foley Hoag, Diana was a member of the arbitration and corporate practices of Winston & Strawn LLP in Paris, where she worked on commercial and investment arbitration cases under ICC, ICSID, and UNCITRAL rules.  She also assisted clients in international M&A transactions, drafted multilingual sales agreements and provided general corporate and commercial law advice under French, E.U. and U.S. laws to multinational American and European companies.

  • Murphy Exploration and Production Company v. Republic of Ecuador.  Representing the Republic of Ecuador against a U.S. corporation in an investor-State dispute under the UNCITRAL Rules involving domestic legislation
  • Representing the Republic of Ecuador against a U.S. corporation in an investor-State dispute under the UNCITRAL Rules involving denial of justice claims
  • Gold Reserve v. Bolivarian Republic of Venezuela. Representing Venezuela against a Canadian gold mining company in an ICSID Additional Facility arbitration concerning gold concessions and environmental rights
  • Advising a Latin American country on the enforcement of arbitral awards in multiple jurisdictions, including the United States, France and Russia
  • Representing a state-owned petroleum company in ICC proceedings brought by a consortium in connection with a breach of contract claim relating to enhanced oil recovery techniques
  • Vannessa Ventures Ltd. v. Bolivarian Republic of Venezuela. Representing Venezuela against a Canadian mining company in an ICSID Additional Facility arbitration arising from the cancellation of a gold mining contract
