Over the summer, the Massachusetts Legislature passed new laws that impact employers.
These changes include:
- An amendment to the Massachusetts personnel records law, which adds new responsibilities for employers to notify employees when information that could negatively affect their employment is added to their personnel record. This controversial new law raises many questions, including whether basic communications such as emails are covered by the law, what does "negatively affect employment mean," and what are the consequences for non-compliance.
- The new CORI reform law, by which employers operating in the Commonwealth have new guidelines for how and when employers may obtain and use criminal records.
