Employee leaves present some of the most complex issues for employers. For example, an employee who is on leave for a serious medical condition may have leave rights under federal and state discrimination laws that extend beyond the 12 weeks provided by the Family Medical Leave Act. Under these circumstances, it is often unclear how long an employer must keep the employee’s job open.
