101: Frustrations of Patent Eligibility
This webinar will review two aspects of the ongoing debate over patent eligibility under Section 101, in light of an almost decade-long period of shifting case law changing the applicable standards. First, Erik Huestis, a Foley Hoag partner who focuses on patent prosecution, will discuss how to deal with patent eligibility during prosecution, and some of the safe harbors and rocky shoals that have defined patent prosecution in this changing environment. Then patent litigation partner Jeff Lewis will review how the Federal Circuit and district courts, Congress, and others have expressed their frustration on the issue and proposals to shore up patent eligibility standards.
