Scott Kamholz Appointed Administrative Patent Judge at U.S. Patent and Trademark Office

July 31, 2012

Dr. Scott Kamholz, chair of Foley Hoag LLP’s Patent Reexamination and Post Grant Review Practice, has been appointed an administrative patent judge on the Board of Patent Appeals and Interferences at the U.S. Patent and Trademark Office in Alexandria, Va.

The board decides appeals from rejections in patent applications, reexaminations and reissues. The board also conducts interference proceedings and soon will start conducting inter partes reviews, post grant reviews and derivation proceedings, which are mandated by the Leahy-Smith America Invents Act of 2011.

Kamholz, who also has been a member of Foley Hoag’s Patent Prosecution Practice Group, initially will serve in the appeals division of the board as a member of various three-judge panels that decide appeals from rejections in patent applications.

“This is a tremendous honor for Scott,” said Don Ware, chair of Foley Hoag’s Intellectual Property Department. “Scott’s legal and scientific expertise helped clients navigate the intricacies of a rapidly changing patent environment. While we will miss him, we are proud that he is pursuing a new and exciting chapter in his career and pleased to know that his leadership in the patent field will continue through public service.”

Kamholz has extensive experience representing both patent owners and third-party challengers in patent reexamination proceedings. He obtained patents for clients in all fields, with an emphasis on applications in medical devices and biotechnology. He represented clients in patent licensing transactions, provided patent due diligence guidance in mergers and acquisitions, and consulted in patent litigation.
