Foley Hoag Associate Oonagh Sands Authors Chapter for BIICL

Oonagh Sands, an associate in Foley Hoag LLP's International Litigation and Arbitration Practice, recently authored a chapter in Procedural Fairness in International Courts and Tribunals, published by the British Institute of International and Comparative Law (BIICL).

The chapter, entitled "Procedural Fairness in Investor-State Arbitration," explores the extent to which concepts of procedural fairness have permeated the increasingly popular method of dispute resolution that is investment-treaty arbitration. Within the text, Sands examines certain particularities that set investment-treaty arbitration apart from other systems of dispute resolution. She also provides an overall assessment of where procedural fairness stands today in investment-treaty arbitration and notes the issues that still remain unresolved and unexplored in the system.

The complete book frames the study of procedural fairness as the identification of fundamental principles inherent to international judicial and arbitral processes. It draws together a number of pertinent issues on specific aspects of fairness before international courts and tribunals; identifies patterns of commonality and divergence in the core standards of procedural fairness of international courts; and develops a holistic understanding of the nature of procedural fairness and the challenges to its realization in the international judicial system.

As a member of Foley Hoag's Sovereign Representation and International Litigation & Arbitration groups, Sands' practice is focused on public international law and investor-State arbitration, where she acts for sovereign States and their State-owned entities.
