Foley Hoag to Sponsor American Conference Institute's 7th Annual Summit on Biosimilars

Foley Hoag LLP will be the lead sponsor of the American Conference Institute's 7th Annual Summit on Biosimilars, being held at the New York Marriott Downtown in New York from June 13-15, 2016. Foley Hoag intellectual property attorneys Donald Ware, Barbara Fiacco and Jenevieve Maerker are speaking.
Ware, who heads Foley Hoag’s Intellectual Property Department, has served as Co-Chair of this event since its inception in 2010. He will provide opening remarks on June 13 with fellow Chair Betty Ryberg, Senior Counsel at West Pharmaceutical Services, Inc.
Ware will also participate on a panel titled “Case Study: Amgen Inc. v. Sandoz Inc. and the Impact on the Patent Dance and the Notice of Commercial Marketing” (June 13). This session will explore the ramifications on the patent process in the biosimilars industry.
Fiacco will participate on a panel titled “Demystifying IPRs for Effective Use in the Biosimilars Landscape” (June 13). Topics of discussion will include analyzing IPR trends and statistics in the pharmaceutical industry; preparing strategies for an IPR versus litigating in federal court; exploring IPR cases in the life sciences context where PTAB has declined to review to develop strategies for successful arguments; and best practices for appearing before the PTAB.
Maerker will be a panelist on “Developing Real World Strategies for Marketing and Promoting a Biosimilar: Distinguishing the Biosimilar from the Reference Product” (June 14). This session will examine best practices for preserving trademark rights for biosimilar products; preparing for products liability claims based on the marketing and promotion of biosimilars; and the impact of Amarin Pharma, Inc. v. FDA on off-label marketing of biosimilars.
