Foley Hoag Partner Barbara Fiacco Named Managing IP Litigator of the Year in Massachusetts

Foley Hoag LLP partner and current president of the American Intellectual Property Law Association (AIPLA) Barbara Fiacco has been named Outstanding Litigator of the Year in Massachusetts in this year’s Managing IP Awards. Now in its 15th year, the Managing IP Awards recognizes remarkable achievements and developments in the past 12 months of leaders in the space.
As a co-chair of Foley Hoag's Patent, Trade Secrets and Related Rights Litigation practice, Fiacco represents clients in complex intellectual property and patent litigation matters. Her technology-related practice focuses on the biomedical field, including cases involving recombinant DNA, monoclonal antibodies, fusion proteins, siRNAs, small molecule compounds, drug delivery systems, molecular diagnostics and medical devices. She has defended pharmaceutical and life sciences clients in significant patent infringement lawsuits that have resulted in summary judgment or other favorable outcomes for her clients. Fiacco also represents these clients in contract disputes and other commercial litigation.
In 2019, Fiacco played an integral role in securing a win for Dana-Farber Cancer Institute on a challenge of inventorship for groundbreaking cancer immunotherapy patents. The U.S. District Court ruled that Dana-Farber scientist, Gordon Freeman, PhD, and another scientist, Clive Wood, PhD, are co-inventors on a series of cancer immunotherapy patents previously issued to a Japanese researcher and Japanese drug company.
Fiacco has been the recipient of numerous accolades in recognition of her excellence within the intellectual property sector. In October 2019, she became president of the AIPLA as well as the United States section of the International Association for the Protection of Intellectual Property (AIPPI-US). Fiacco leads AIPLA’s judicial and legislative advocacy efforts and, in June 2019, testified on patent subject-matter eligibility reform before the Senate Judiciary Committee’s Subcommittee on Intellectual Property. In addition, Best Lawyers named Fiacco as Boston’s Biotechnology Lawyer of the Year in 2018 and Boston’s Biotechnology and Life Sciences Practice Lawyer of the Year for 2020. Fiacco currently appears on Managing Intellectual Property's Top 250 Women in IP list and IP Stars list, for which she is recognized as a Patent Star for Massachusetts. Fiacco received a J.D. cum laude from Harvard Law School, and Bachelor of Arts magna cum laude from Dartmouth College.
