September 23, 2020

Foley Hoag LLP partner Jeffrey I.D. Lewis serves as a co-editor-in-chief and co-author of Privilege and Professional Confidences: An International Review published by Bloomberg Law.

This new book provides both outside and in-house legal practitioners and also individuals and businesses seeking legal advice on domestic and international levels with information regarding the metes and bounds of protection from forced disclosure of privileged communications.

Privilege and Professional Confidences: An International Review also addresses issues that may arise in maintaining privilege in such cross-border confidential communications for a number of jurisdictions including the United States, Canada, Australia, the United Kingdom, Switzerland, the Netherlands and European Union, among others. Also discussed are a number of international initiatives regarding the development of an internationally harmonized protection of communications between IP owners and their IP legal providers.

Lewis' chapter, "United States of America," co-authored with Michel Samalin of Norton Rose Fulbright, explores attorney-client privilege and work product immunity, as well as settlement and mediation privileges, under federal law before the courts and administrative agencies as well as looking at the law of each state and territories. The chapter addresses the confidential nature of communications involving corporations, in-house counsel, non-attorney patent professionals and parties having a common interest.

Lewis, who recently joined Foley Hoag, represents pharmaceutical innovators in ANDA patent litigations. He also concentrates on patent and trademark litigation, counseling, and licensing, as well as other intellectual property and general litigation. Lewis regularly represents plaintiffs and defendants in a range of technology-related sectors with a focus on pharmaceuticals, chemicals, mechanical/medical-device, biotechnology and life sciences.
