Laura D. Gradel

Laura Gradel is a commercial litigator and trial lawyer who has resolved complex litigation disputes for clients in a diverse array of industries. She has broad litigation experience, including commercial disputes, antitrust matters—both civil disputes and government challenges—noncompete and trade secret litigation, products liability cases, and consumer lawsuits under the Fair Credit Reporting Act.

Laura also maintains a vibrant pro bono practice, honing her trial skills by advocating for asylum seekers in immigration proceedings and using her strong writing skills to draft amicus briefs. Laura has experience in all phases of litigation and dispute resolution, including written discovery, offensive and defensive depositions, motion practice, mediations, jury trials, arbitration and settlement negotiations.

Prior to joining Foley Hoag, Laura was a litigation associate at the Boston office of an international law firm where she built a strong foundation as a commercial litigator, handling a variety of matters in state and federal courts throughout the United States.  At Foley Hoag, Laura has expanded her practice to include labor and employment litigation and commercial arbitration.

In the pro bono space, Laura is committed to serving the greater Boston community.  She has contributed to amicus briefs, advocated for asylum seekers in immigration proceedings, and represented clients in guardianship proceedings in Massachusetts probate courts.  She also reviews grant applications for the Foley Hoag Foundation, which allows her to engage with individuals and organizations serving her Boston community.

  • Core member of trial team that secured a complete defense verdict on behalf of a Major League Baseball team in first foul ball injury jury trial in Massachusetts.* 
  • Served as lead pro bono trial counsel for Venezuelan client seeking political asylum and successfully obtained asylum for client and his family.*
  • Secured temporary restraining order and favorable settlement for medical supply company seeking to enforce noncompete and nondisclosure agreement against former employee
  • Ongoing representation of municipality in claim of sex discrimination before the Massachusetts Commission Against Discrimination (“MCAD”).
  • Drafted and issued demand letters for employers seeking to enforce noncompete agreements for employers in a variety of industries, including clean energy.
  • Ongoing representation of pharmaceutical company in contract dispute related to COVID-19 clinical trial
  • Secured dismissal of claims of breach of contract and fraud against Bangladesh telecommunications agency 
  • Efficiently negotiated settlement of contract dispute for nonprofit client and avoided potentially significant financial consequences
  • Counseled non-party witnesses on preparing for depositions
  • Lead defense counsel in Fair Credit Reporting Act (FCRA) consumer lawsuits in state and federal courts throughout New England in which she advised client on strategy and efficiently resolved cases through motions to dismiss and effective settlement negotiation.*
  • Successfully negotiated resolution of stolen product & trademark infringement litigation with pro se defendants following witness interviews and extensive fact investigation.*
  • Represented pharmaceutical company in putative class action alleging that the company engaged in anticompetitive conduct resulting in higher prices for direct purchasers of insulin products.*
  • Drafted report on behalf of Demand Review Committee investigating demand from shareholder for investigation of a fund management fee.
