Joanna McDonough is an associate in the firm’s Litigation Department. Her broad litigation practice spans white collar defense and government investigations, complex commercial litigation, and patent litigation. She regularly represents clients in the healthcare, biotechnology, pharmaceutical and diagnostic lab industries. Joanna is also active in the firm’s pro bono program and was recently named to the Massachusetts SJC’s Pro Bono High Honor Roll for her contributions.

Representative Experience

  • Defended genetic test company in federal False Claims Act litigation concerning allegations of violations of the Anti-Kickback Statute.
  • Serving as counsel to a Monitor selected by the Department of Justice and Securities and Exchange Commission to assess a major Boston financial institution’s compliance program and compliance with a Deferred Prosecution Agreement.
  • Defended genetic testing company and negotiated settlement of whistleblower complaint in investigation initiated by OIG, Health & Human Services subpoena concerning potential False Claims Act violations.
  • Represented genetic testing company in arbitration concerning insurer’s allegations of improper billing practices.
  • Represented a solar PV investor in connection with a dispute regarding alleged payments due from the purchase of a portfolio of solar projects, resulting in the negotiation of a favorable settlement.
  • Represented Becton, Dickinson and the Regents of the University of California in patent infringement litigation asserting multiple patents covering polymer dye reagents and their use in flow cytometry, resulting in the negotiation of a favorable settlement just before trial.
