Christian Springer helps healthcare and biotech companies navigate statutory and regulatory issues involving the Center for Medicare & Medicaid Services (CMS), the Health Resources and Services Agency (HRSA) and the Food and Drug Administration (FDA). He regularly helps medical product clients resolve coverage and reimbursement issues under the Medicare and Medicaid programs, including the 340B program. As part of this work, Christian advises clients on requirements governing agency authority under the Administrative Procedure Act (APA) and has successfully advocated for policy changes through interim final rulemaking. He also has extensive experience advising gene therapy companies on policies relating to value-based purchasing arrangements and health care reform generally.

Representative Experience

  • Advising a Fortune 200 IT company on conflict of interest provisions relating to Medicaid managed care organizations and federal financial participation funding.
  • Drafting a legal memorandum for a national trade association detailing legal vulnerabilities to a potential CMS policy involving drug pricing in the Medicare Part D program.
  • Advising a pharmaceutical manufacturer on strategic reimbursement for biologics.
  • Summarizing and evaluating bio-pharmaceutical stakeholder positioning on the proposed Part B Drug Payment Demonstration.
  • Developing a legal argument, in response to a Request for Information, under Section 1557 of the ACA to inform CMS policy towards the Health Insurance Exchanges.

Professional Experience

Prior to joining Foley Hoag, Christian was a Law Clerk for The Law Offices of Jason M. Healy, a health care regulatory firm representing acute long-term care hospitals and other specialty providers. Before that, he was a Judicial Intern for The Honorable Judge Laura A. Cordero of D.C. Superior Court, where he drafted orders adjudicating a range of civil cases.
