Overview
The members of Foley Hoag’s international litigation and arbitration department practice with the shared goal of providing clients with exceptional and effective professional service. Collectively they make up what is recognized as one of the world’s leading international arbitration practices.
Foley Hoag’s international litigation and arbitration team is active on matters across the globe. Composed of some 60 lawyers of more than 40 nationalities, the team is one of the largest, most richly diverse and most experienced on the market. The Paris office contingent includes a dozen arbitration specialists (seven partners, one special counsel, one counsel and eight associates). These lawyers based in Paris work seamlessly with their peers in the firm’s Boston, New York and Washington DC offices.
The practice is structured around two principal axes: investor-State arbitration and inter-State litigation, on the one hand, and commercial arbitration, on the other.
Foley Hoag’s lawyers are thus routinely involved in public international law disputes based on international treaties, including disputes regarding investment protection, maritime and land boundary delimitation and State responsibility under international law. They appear in proceedings under the auspices of institutions with both general (e.g., ICJ, ICSID, PCA) and specific (e.g., ITLOS, NAFTA) jurisdiction.

Foley Hoag also offers a range of leading services in the field of international commercial arbitration. The Paris practice is headed by highly-experienced lawyers whose backgrounds provide them with a deep understanding of the cross-border environment, including with respect to mergers and acquisitions, corporate law and international contracts. The firm’s clients – which consist of both French and international actors – benefit from these lawyers’ strategic vision for managing disputes efficiently and pragmatically, while never overlooking negotiated alternatives or mediation.
Recognized in particular for their mastery of questions of arbitral procedure, our lawyers represent clients in contract disputes arising in all the primary sectors of industry and the economy, whether it be in the context of ad hoc arbitration or arbitrations administered by the leading arbitration institutions, such as the ICC.
Foley Hoag’s lawyers are, in addition, experienced court practitioners and appear in the context of both independent judicial proceedings and those arising in connection with international litigation or arbitration proceedings (e.g., for the recognition and enforcement of arbitral awards or the opposition thereto, including set aside actions, recognition and enforcement of foreign judgments, obtaining evidence for use in foreign legal proceedings, sovereign immunity from jurisdiction and enforcement, challenges to jurisdiction, etc.).
