Justices Won't Disturb 10th Circ. Oklahoma PBM Law Ruling

A recent Law360 article highlighted an important victory for Foley Hoag client Pharmaceutical Care Management Association (PCMA), in which the U.S. Supreme Court declined review of a Tenth Circuit Court of Appeals case decided in favor of PCMA.
In PCMA v. Mulready, Oklahoma sought to challenge the 2023 Tenth Circuit decision that struck down parts of a recently enacted state law regulating pharmacy benefit managers. The ruling in favor of PCMA found that Oklahoma’s 2019 statute regulating pharmacy benefit managers was preempted by federal statutes as well as Medicare Part D.
