Foley Hoag LLP lawyers Joseph Basile, Christina Beharry, Nicholas Renzler and Diana Tsutieva will participate on panels at the American Bar Association (ABA) Section of International Law’s 2018 Annual Meeting, being held April 17-21 in New York. This year’s theme is “At the Crossroads: The Fusion of Private and Public International Law.”
Basile’s panel, “Banker Liability in M&A Transactions: Recent Developments Regarding Independence, Conflicts of Interest and Fairness Opinions,” will examine evolving trends in Canada, Europe and the U.S., and will provide guidance for deal-lawyers representing targets and bankers in M&A transactions. Basile is a co-chair of Foley Hoag’s Business Department and its Mergers & Acquisitions Practice Group.
Beharry will take part in "Dueling Privilege Rules: Resolving Conflicts of Law Over Privilege in International Arbitration,” a panel focusing on how a claim of privilege as an impediment to production should be resolved. Panelists will discuss how to determine which jurisdiction’s privilege rules apply or if international law should govern and what the ideal characteristics of international privilege norms are. Renzler will serve as panel chair and moderator.
Tsutieva’s panel, “The Rise of Foreign Agent Laws: The Emerging Trends in their Enactment and Application in the U.S., Russia and Across the Globe,” will explore the application of The U.S. Foreign Agents Registration Act (FARA), Russia’s Foreign Agents Law (which is modeled on FARA), and similar laws that have been enacted in other states across the globe.

It is the only ABA entity that focuses on the full range of international legal issues and is involved in a wide variety of substantive legal activities.
