Patrick Scully was quoted in the Law360 piece, “DC Circ. Rebukes NLRB’s ‘Nonsense’ In Driver Camera Case' discussing the D.C. Circuit rule in Stern Produce Co. Inc. v. National Labor Relations Board, which vacated a National Labor Relations Board ("NLRB") decision that found that his client, Stern Produce unlawfully disciplined a pro-union worker and gave another the impression he was being surveilled.
In its decision, the D.C. Circuit said the NLRB did not have substantial evidence to support either conclusion.
