Foley Hoag partner Beth Neitzel was recently mentioned in a
Law 360 article on ongoing litigation on behalf of client Power Forward Communities (PFC), in its challenge to the Trump administration’s attempt to unlawfully terminate PFC’s $2 billion grant under the Greenhouse Gas Reduction Fund (GGRF). Neitzel told the court during proceedings on April 2, 2025, that the Trump administration offered a variety of inconsistent “post-hoc rationales” for terminating PFC’s grant, and that the government also never offered an explanation as to how canceling PFC’s grant and returning GGRF funds to the Treasury would increase government oversight.
Neitzel later said, “Our client has acted in good faith to deliver on its commitments to the American public. As yesterday’s hearing confirmed, EPA’s grounds for seeking to terminate PFC’s grant are unlawful and pretextual. We look forward to a swift decision here that will enable PFC to continue its important work."
A decision is expected in the coming days. PFC's full Foley Hoag team was also cited along with Neitzel: Noah Shaw, Jack Smith, James Gross, Kevin Chen and Peter Ross.
