Jesse Alderman, partner and co-chair of the firm’s Cannabis and Hemp group, was quoted in MJBizDaily on the growing number of medical cannabis operators seeking registration with the U.S. Drug Enforcement Administration following recent federal rescheduling developments. Alderman noted that while the full implications of registration remain uncertain, it “certainly won’t hurt” the medical cannabis industry and could provide meaningful advantages depending on how federal policy evolves. He explained that “if and when broader rescheduling is completed, then the same market dynamics as today likely will hold,” but added that “if for any reason broader rescheduling does not occur, medical cannabis instantly has a host of new advantages.”
Alderman also emphasized the potential financial impact of registration, particularly with respect to tax treatment, observing that relief from Internal Revenue Code Section 280E represents one of the most significant opportunities for operators. For companies in large medical-only markets like Florida or Pennsylvania, he noted, “the potential tax savings prospectively are tremendous.”
