Mack Ramsden advises solar, onshore and offshore wind, energy storage, and transmission project developers, as well as load-serving entities and capital investors, on a range of regulatory, contracting, and financing questions.
Mack represents energy-sector clients in regulatory matters including siting and permitting proceedings, state-, RTO-, and federally-administered procurements, and FERC and state energy regulatory compliance proceedings. He also assists developers and investors in negotiating and executing financing arrangements and transactions.
Mack has extensive experience helping clients navigate state permitting and federal energy regulatory compliance regimes. He has represented generators and storage facilities at all stages of the Section 94-c permitting process at New York’s Office of Renewable Energy Siting. He represents clients before the Federal Energy Regulatory Commission (“FERC”) in routine regulatory compliance matters for energy project developers, including the development and filing of EWG and QF self-certifications and MBR applications. Mack frequently files comments in FERC dockets to advance client positions on agency rulemakings and to contest utility rate filings and RTO compliance filings, and has represented clients in complex, high-stakes FERC-jurisdictional disputes.
In addition, Mack represents clients vis-à-vis transmission system operators (including the NYISO, ISO-NE, PJM, and ERCOT) and state agencies with regard to executing interconnection strategies and entering bids for project awards.
Mack also drafts and negotiates a variety of contracts for energy companies and projects, including power purchase agreements and REC purchase-and-sale agreements, LLCAs and other project development agreements, and grant funding contracts with the U.S. Environmental Protection Agency and U.S. Department of Energy.
For clients contemplating transactions of operational or in-development energy sector assets or enterprises, Mack performs state and federal regulatory, interconnection, and contractual due diligence.
Before joining Foley Hoag, Mack worked as a legal consultant at Rise Light & Power, a New York-based energy asset manager and developer. While in law school, he spent a year in the office of FERC Commissioner Allison Clements and interned in the office of the General Counsel at the Department of Energy Loan Programs Office and at the energy regulatory policy think tank Institute for Policy Integrity at NYU School of Law. Previously, Mack worked as an analyst advising companies in Massachusetts on energy policy and environmental regulations.
